Rubbish Removal Canary Wharf Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Canary Wharf provides rubbish removal and waste collection services to customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Service means any rubbish removal, waste collection, disposal, clearance or related service provided by us.

Customer means any individual, business, property manager or other party who requests or receives the Service.

Waste means any items, materials, rubbish, junk or refuse presented by the Customer for removal, excluding items that are prohibited or require special handling as described in these terms.

Site means the premises, building, land or other location where the Waste is to be collected.

We, us and our refer to the service provider trading as Rubbish Removal Canary Wharf.

2. Scope of Service

We provide waste removal and rubbish clearance services in and around Canary Wharf and nearby areas. The specific nature and scope of the Service will be as agreed at the time of booking, based on the information you provide about the Waste, access and any special requirements.

Our Service generally includes loading eligible Waste from the agreed Site, transporting it and delivering it to a licensed facility for disposal, recycling or recovery in accordance with applicable waste regulations. We do not provide building or structural works, plumbing, electrical or other specialist trades unless expressly stated in writing.

3. Booking Process

3.1 Booking request

You may request a booking by telephone, email or online enquiry form, where available. When you contact us, you will be asked for details of the Site, the type and approximate volume or weight of Waste, access arrangements, desired date and time, and any special instructions.

3.2 Accuracy of information

You are responsible for ensuring that all information provided at the time of booking is complete and accurate. Our quote and the suitability of our Service are based on the description you provide. If on arrival we find that the Waste, access or Site differ significantly from what was described, we reserve the right to adjust the price, alter the Service or decline to proceed.

3.3 Confirmation

A booking will be treated as confirmed when we acknowledge acceptance of your request and provide a date and time window for the Service. We may issue written or electronic confirmation. We may refuse a booking at our discretion, including where the Waste is unsuitable or cannot be managed safely or legally.

3.4 Time windows

We will use reasonable endeavours to attend within the agreed time window. However, all times are estimates only and may be affected by traffic, weather, operational issues or other factors beyond our reasonable control. We will not be liable for any loss caused by delay, but we will keep you informed and rearrange if necessary.

4. Access and Customer Responsibilities

4.1 Access to the Site

You must ensure that our staff and vehicles have safe, reasonable and lawful access to the Site at the agreed time. This includes arranging parking, entry codes, building permissions and any permits where required. If access is restricted or delayed, we may charge waiting time or an additional attendance fee.

4.2 Preparation of Waste

Waste should be reasonably accessible, not excessively obstructed and free from contamination by hazardous or prohibited items. Heavy or bulky items should be identified in advance. Where possible, items should be separated if required by local waste regulations or by prior agreement with us.

4.3 Attendance at the Site

The Customer, or an authorised representative, must be present at the Site during the Service unless expressly agreed otherwise. You must ensure that any necessary consents from property owners, landlords or managing agents are in place.

5. Waste Types and Prohibited Items

5.1 Acceptable waste

We can collect a wide variety of household, office and commercial waste, including general rubbish, furniture, appliances, garden waste and non-hazardous construction debris, subject to our vehicle capacity and safety requirements.

5.2 Prohibited or restricted items

Certain waste types cannot be collected or require special arrangements, including but not limited to hazardous chemicals, asbestos, medical waste, pressurised containers, explosives, flammable liquids, vehicles, fuel and other items restricted by waste regulations or health and safety law. We reserve the right to refuse any item that we consider unsafe, illegal or unsuitable.

5.3 Misdescription of waste

If we discover that the Waste includes prohibited or hazardous items that were not disclosed at booking, we may refuse to remove them, adjust the price to cover additional handling and disposal costs, or cancel the Service. You will be responsible for any costs we incur as a result of misdescribed Waste.

6. Pricing and Payment

6.1 Quotations

Prices are generally based on the estimated volume, weight, type of Waste and the labour and access required. Any quotation given before attending the Site is an estimate only, based on the information you provide. The final price may change if the actual Waste or Site conditions differ.

6.2 On-site assessment

Upon arrival, our staff will assess the Waste and confirm the final price before commencing work. If you agree, we will proceed with the Service. If you do not agree to the revised price, we reserve the right to cancel the Service and may charge a call-out fee to cover our costs.

6.3 Payment terms

Unless agreed otherwise in writing, payment is due immediately upon completion of the Service at the Site. We may accept cash, card or other electronic payment methods, subject to availability. For business Customers with approved credit accounts, alternative payment terms may apply as expressly agreed.

6.4 Late payment

If payment is not received when due, we may charge interest on overdue sums at the statutory rate and recover any reasonable costs of collection. Ownership of any Waste does not transfer back to you even if payment is delayed; however, we reserve all legal remedies for non-payment.

7. Cancellations and Amendments

7.1 Customer cancellations

You may cancel or amend a booking by providing us with reasonable notice before the agreed arrival time. For standard bookings, we ask for at least 24 hours notice. If you cancel with less notice, we may charge a cancellation fee to cover our costs and lost time.

7.2 Our right to cancel

We may cancel or suspend a booking if we are unable to provide the Service due to circumstances beyond our control, including extreme weather, vehicle breakdown, staff illness, safety concerns or regulatory restrictions. We may also cancel if the Waste is unsuitable, access is unsafe or the Customer is in breach of these terms. In such cases, any pre-paid amounts relating to the cancelled Service will be refunded, except where cancellation is due to your breach.

7.3 Rescheduling

Where possible, we will offer to reschedule the Service to a mutually convenient time. Rescheduling is subject to availability and may require updated pricing if the scope of work changes.

8. Customer Conduct and Health and Safety

8.1 Safe working environment

You must ensure that the Site is safe for our staff to work, free from unreasonable hazards and compliant with health and safety requirements. We may refuse to work or stop the Service if we believe it would be unsafe to continue.

8.2 Behaviour

You must treat our staff with respect and must not engage in abusive, threatening or discriminatory behaviour. We reserve the right to withdraw service and leave the Site if such behaviour occurs, and to charge for any time spent or costs incurred.

9. Liability and Limitations

9.1 Duty of care

We will exercise reasonable care and skill in providing the Service. We will handle Waste and operate at the Site in a professional manner consistent with industry practice.

9.2 Damage to property

We will take reasonable steps to avoid damage when removing Waste. However, you are responsible for protecting floors, walls, fixtures and fittings, and for moving any items that are delicate, valuable or easily damaged. We will not be liable for normal wear and tear, superficial marks or damage arising from necessary movement of bulky items through confined spaces where you have agreed we should proceed.

9.3 Exclusions of liability

We will not be liable for indirect or consequential losses, loss of profit, loss of opportunity or loss of business arising out of or in connection with the Service. Our total liability to you for any claim arising from the Service shall not exceed the total fees paid or payable for that particular Service, except where liability cannot lawfully be limited or excluded.

9.4 Personal injury and death

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot be excluded under applicable law.

10. Waste Regulations and Environmental Compliance

10.1 Legal disposal

We operate in accordance with applicable UK waste management and environmental regulations. Waste collected by us will be transferred to appropriately licensed or permitted facilities for treatment, recycling, recovery or disposal as required by law.

10.2 Waste transfer documentation

Where required, we will complete waste transfer notes or other documentation to record the transfer of Waste from you to us or our authorised partners. By using our Service, you authorise us to complete such documentation on your behalf as necessary.

10.3 Customer obligations

You must not request us to remove Waste in a manner that would breach environmental, waste management or health and safety regulations. You remain responsible for any consequences of providing misleading or incomplete information about the nature of the Waste.

11. Insurance

We maintain public liability insurance and other cover appropriate to the nature of our operations. Evidence of insurance may be provided on request. Our insurance does not replace your own insurance for the Site or for any items not intended to be removed.

12. Complaints and Dispute Resolution

If you are dissatisfied with any aspect of our Service, you should contact us as soon as possible, providing details of the issue, the Site and the date of service. We will investigate and, where appropriate, offer a remedy such as re-attendance, partial refund or other reasonable solution.

We aim to resolve complaints promptly and fairly. If a dispute cannot be resolved directly, both parties agree to consider in good faith any reasonable proposals for alternative dispute resolution before commencing formal legal proceedings.

13. Data Protection and Privacy

In providing the Service, we may collect and process personal data such as your name, contact details, address, payment information and service history. We will handle such data in accordance with applicable data protection legislation and only for legitimate business purposes, including managing bookings, processing payments, improving our services and meeting legal obligations.

By using our Service, you consent to the collection and use of your information for these purposes. You have rights in relation to your personal data, including the right to access certain information we hold about you and to request corrections where appropriate.

14. Amendments to these Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, industry practice or our business operations. The version in force at the time of your booking will apply to that Service. Updated terms may be made available on request or published on our website where applicable.

15. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or regulator, that provision shall be treated as removed to the extent necessary, without affecting the validity and enforceability of the remaining provisions.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or relating to these Terms and Conditions or the provision of our rubbish removal and waste collection services.

By proceeding with a booking or allowing our staff to commence work at the Site, you confirm that you have read, understood and agreed to these Terms and Conditions.
